Thank you for submitting a photo(s) and story to be considered for the Be the Difference-NeverAgain, LTD World War II education and commemoration campaigns. To proceed, please complete the release below to grant permission to use the content you provided.

By sending the photo(s) and story, you agree to the following:

 

1. Grant of Rights

I, the undersigned, hereby grant Be The Difference - Never Again, LTD, its affiliates, licensees, successors, and assigns (collectively, “the Organization”) the perpetual, sublicensable, worldwide right to use, reproduce, display, publish, distribute, and otherwise utilize the photograph(s), written story or description, and any associated likenesses or names submitted by me (the “Materials”), in whole or in part, in connection with the Organization’s WWII education and commemoration campaigns. This includes use in print, outdoor (billboard), digital, social media, traditional broadcast, websites, educational materials and any other promotional formats. I understand that I will not receive any monetary compensation for the use of the Materials.

2. Ownership and Authority

I confirm that (a) I am the owner of the Materials or have the authority to submit them; (b) use of the Materials will not infringe any third-party rights; and (c) if any individuals depicted or referenced in the Materials are living, I have their permission or am authorized to provide this release on their behalf and if any individuals are deceased, I have legal authority to share their likeness for these purposes.

3. Release and Indemnity

​

I hereby release the Organization, the property owner(s), and operator(s) of any billboard(s) or other advertising media where the Materials may be displayed and the respective affiliates, officers, employees, and agents of all of the foregoing, from any and all claims or liabilities arising out of or related to the use of the Materials. This includes use in print, outdoor (billboard), digital, social media, traditional broadcast, websites, educational materials and any other promotional formats. I agree to indemnify and hold all of the foregoing harmless from any third-party claims arising from my submission, including claims related to rights in the Materials or the individuals shown in them.

4. Governing Law

​

This Release shall be governed by the laws of the State of New York, without regard to conflict of law principles. Venue for any dispute arising under or related to this Release shall lie exclusively in the state or federal courts located in New York County, New York.
